The purpose of the contract is the authorization to occupy the temporary occupation of the public domain for the operation From the restaurant "Le Bistrot d'O", located within Domaine d'O to 178 rue de la Carrirasse in Montpellier (34090). It sets the terms by which the EPCC authorizes the occupant to have the spaces determined in article 1.2 of the consultation regulations and to exploit there at its risk exclusive to catering activity. The occupant must pay the EPCC, in return for the right to occupy the public domain, an annual fee taking into account the advantages of all kinds provided by the authorization. The EPCC wants the occupant to support the economic exploitation of the restaurant. It is also specified that the decoration and arrangements are borne by the occupant and are previously submitted for opinion to the EPCC. The contract is subject to the rules of public state. The exploitation of the establishment do not give it the character of a public service. Consequently, this contract is not subject to the rules applicable to concession contracts.
