The consultation is launched in the form of a procedure with negotiation according to articles R2124-4 and R2161-21 to R2161-23 of the Public Order Code (CCP). The Region is qualified as a contracting entity for purchases of goods made within the framework of its activities as a network operator and intendedto the provision of a network operator (article L1212-1 and L1212-3-4 of the CCP). In this case, the market has the purpose of acquiring automatic trains to stop (DAAD) for trains in the Provence railways and intended for the provision of the operator of the operatorProvence railways. For this purchase, the region is therefore a contracting entity.
