Description:
The framework agreement will be executed by the emission of purchase orders.
Each batch will be the subject of a separate award.
The services are paid by unit prices.
Decree n 2011-1474 of November 8, 2011 provides that the conclusion of a collective additional social protection contractRVIENNE at the end of an ad hoc procedure for advertising and competition, which does not fall under the provisions of the public order code.
However, these provisions were taken within a framework which did not fix at the time any obligation of participation of the employer.The employer's participation, introduced by ordinance n 2021-175 of February 17, 2021, now codified in articles L. 827-1 to L. 827-12 of the general public service code, is likely to modify the legal regime whose competition must be noted, and toSubmit to the law of public procurement the procedures to be carried out. Indeed, due to the compulsory nature of the employer's participation, it can no longer be supported that participation agreements aim to cover only the insurance needs of agents, and notBeautiful a proper need for the public person.
